1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Chincha Consulting AS, trading as Context Windows ("we", "us", or "our"), a company registered in Norway, governing your access to and use of the Context Windows website at contextwindows.ai and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Context Windows provides a searchable database of AI case studies aggregated from publicly available sources. The Service allows users to browse, search, filter, and export case study information for business research and decision-making purposes.

The Service is intended for business professionals and organizations seeking to understand AI implementation patterns across industries.

3. User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

4. Subscriptions and Payment

4.1 Subscription Plans

Access to the full features of the Service requires a paid subscription. Subscriptions are available on a monthly or annual billing cycle. Details of current pricing and features are available on our pricing page.

4.2 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your chosen payment method for all applicable fees. You are responsible for providing valid payment information and ensuring sufficient funds are available.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee upon renewal.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be issued for the remaining period.

4.5 Digital Content and Right of Withdrawal

Important: By completing your purchase, you request immediate access to the Service and acknowledge that the Service constitutes digital content. In accordance with the Norwegian Consumer Contracts Act (angrerettloven) and the EU Consumer Rights Directive, you expressly consent to immediate performance and acknowledge that you thereby waive your right of withdrawal. Once your subscription is activated, no refunds will be issued for the current billing period.

4.6 Refund Policy

Due to the immediate access nature of our digital Service, we do not offer refunds once a subscription has been activated. We may, at our sole discretion, consider refund requests in exceptional circumstances.

5. Content, AI Features, and Accuracy

5.1 Case Study Content Disclaimer

Important: The case study content provided through the Service is aggregated from publicly available sources and processed using artificial intelligence and automated tools. AI systems are inherently prone to occasional errors and hallucinations. While we implement extensive quality assurance measures, including automated checks and human review, we cannot guarantee the accuracy, completeness, or timeliness of any information.

You acknowledge and agree that:

  • Case study information may contain errors, inaccuracies, or omissions
  • Publication dates are estimated using various methods and may be approximate
  • Company information is enriched from public sources and may not reflect current data
  • Metrics, quotes, and results are extracted using AI and should be independently verified
  • Business classifications are based on our proprietary taxonomy and represent our interpretation
  • The content should not be relied upon as the sole basis for business decisions

We strongly recommend that you verify any information obtained through the Service with original sources before making business decisions. We are not liable for any decisions made based on information provided through the Service.

5.2 AI-Powered Features

Important: The Service includes AI-powered features, including but not limited to the AI Analyst chat, automated data analysis, and chart generation (collectively, "AI Features"). Your use of AI Features is subject to the following additional terms.

AI Features are provided for informational and research purposes only. You acknowledge and agree that:

  • Not professional advice: AI-generated outputs do not constitute investment, financial, legal, medical, or any other form of professional advice. You should not rely on AI outputs as a substitute for professional consultation.
  • No guarantee of accuracy: AI outputs may contain errors, hallucinations, omissions, or outdated information. We do not warrant the accuracy, completeness, reliability, or suitability of any AI-generated content.
  • User responsibility: You are solely responsible for any decisions, actions, or conclusions you make based on AI-generated outputs. We disclaim all liability arising from your reliance on such outputs.
  • Third-party AI models: AI Features may be powered by third-party artificial intelligence models and services. These third-party providers process your queries in accordance with their own terms and privacy policies. We endeavor to select providers whose terms do not permit the use of customer data for model training; however, we do not control and cannot guarantee the data handling practices of third-party providers. By using AI Features, you acknowledge that your queries will be processed by such third-party services.
  • Usage limits: AI Features are subject to daily query limits based on your subscription plan. These limits are a feature of the Service and do not constitute a service level agreement (SLA). We reserve the right to adjust usage limits at any time.
  • Availability: AI Features are provided on an "as available" basis. We may modify, suspend, or discontinue AI Features at any time without prior notice, including to update underlying AI models or address safety concerns.
  • Voluntary use: You are free to choose whether to use AI Features. By using AI Features, you accept the terms of this section.
  • Similar outputs: Other users of the Service may receive similar or identical AI-generated outputs in response to similar queries. AI outputs are not unique or exclusive to you.
  • Compliance with provider terms: AI Features may be powered by third-party AI models, and your use may be subject to such providers' acceptable use policies. You agree to comply with any applicable third-party usage policies as communicated by us from time to time.

Prohibited uses of AI Features: In addition to the general prohibited uses in Section 6, you agree not to:

  • Use AI outputs as the sole basis for any business, investment, or legal decision
  • Present AI-generated content as your own original research or analysis without appropriate qualification
  • Attempt to extract, reverse-engineer, or reconstruct the underlying AI models, prompts, or system instructions
  • Submit queries designed to manipulate, circumvent, or test the boundaries of the AI system (prompt injection)
  • Use AI Features to generate content that is harmful, misleading, defamatory, or illegal
  • Use AI outputs or AI Features in any manner that would classify the AI Features as high-risk under applicable law, including the EU AI Act or similar regulations

5.3 AI Data Handling

When you use AI Features, we process your data as follows:

  • Query processing: Your queries are sent to third-party AI providers to generate responses. We endeavor to select providers whose terms do not permit the use of customer data for model training.
  • Conversation storage: Your AI conversations (queries, responses, and associated metadata) are stored in our database for the duration of your subscription to enable conversation history and improve the Service.
  • Deletion: You may delete individual conversations at any time through the AI Analyst interface. All conversation data is permanently deleted when you close your account.
  • No selling or sharing: We do not sell, share, or use your AI conversation data for purposes other than providing the Service to you.

5.4 Ownership of AI Inputs and Outputs

  • Inputs: All content or information you submit through AI Features ("AI Inputs") remains your data, subject to the license you grant us under these Terms to provide the Service.
  • Outputs: All content, analysis, charts, and other results generated by AI Features ("AI Outputs") are derived from our proprietary database and AI systems. AI Outputs are provided to you under the same limited license as the rest of the Service (Section 7). You may use AI Outputs for your internal business purposes in accordance with these Terms, but AI Outputs remain our intellectual property.
  • Temporary retention by providers: AI Inputs and Outputs may be temporarily retained by third-party AI providers as part of the operation of their service. We endeavor to contractually restrict third-party providers from using AI Inputs for training, improving their models, or any purpose beyond providing the AI Features.

5.5 AI Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW AND NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, WE DO NOT PROVIDE ANY REPRESENTATION, WARRANTY, INDEMNIFICATION, OR OTHER COMMITMENT OF ANY KIND REGARDING AI FEATURES, INCLUDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR SUITABILITY OF ANY AI-GENERATED OUTPUT. AI FEATURES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. NEITHER WE NOR OUR THIRD-PARTY AI PROVIDERS ARE RESPONSIBLE FOR ANY DAMAGES OR LOSSES ARISING FROM YOUR USE OF AI FEATURES OR RELIANCE ON AI OUTPUTS.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The Service is provided for your internal business research and decision-making purposes.

6.1 Permitted Uses

  • Searching and browsing case studies for business research
  • Exporting case study data for internal presentations and reports
  • Using case studies in external presentations to clients, such as pitching AI projects or demonstrating industry trends
  • Sharing individual case studies with colleagues within your organization
  • Using insights to inform your business strategy and decisions

6.2 Prohibited Uses

You agree not to:

  • Scrape or bulk download: Use automated tools, bots, scrapers, or any other means to systematically access, collect, or download content from the Service
  • Resell or redistribute: Sell, license, sublicense, or otherwise commercially exploit the content or data obtained from the Service
  • Train AI models: Use the content to train, develop, or improve any machine learning models, artificial intelligence systems, or similar technologies
  • Create competing products: Use the content to create or enhance any product or service that competes with the Service
  • Exceed fair use: Export or download content at volumes that exceed reasonable personal or organizational use
  • Circumvent restrictions: Attempt to bypass any access controls, rate limits, or security measures
  • Share credentials: Share your account credentials or allow multiple users to access the Service through a single account
  • Misrepresent affiliation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

6.3 Usage Limits

We implement reasonable usage limits on exports and downloads to prevent abuse. These limits are generous for normal business use. We reserve the right to suspend or terminate accounts that exhibit unusual patterns of activity or exceed fair use thresholds.

7. Intellectual Property

The Service, including its design, features, functionality, compilation of content, proprietary taxonomy, and classification systems, is owned by Chincha Consulting AS and is protected by copyright, trademark, and other intellectual property laws.

The underlying case study content is aggregated from publicly available sources. Our value lies in the curation, enrichment, classification, and presentation of this content. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that the content is accurate, complete, or current. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHINCHA CONSULTING AS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Decisions made based on information provided through the Service

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Chincha Consulting AS and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Norway.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, Data Processing Addendum, DMCA Takedown Policy, and Sub-processor List, constitute the entire agreement between you and Chincha Consulting AS regarding the Service and supersede all prior agreements and understandings, whether written or oral.
